1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Beket AI ("beket.ai," "we," "us," or "our"), governing your access to and use of the beket.ai platform available at https://beket.ai (the "Service").

By creating an account, accessing the Service, or clicking any button indicating acceptance, you confirm that:

• You have read, understood, and agree to be bound by these Terms;
• You are at least 18 years of age;
• You have the legal authority to enter into this agreement on behalf of yourself or the organization you represent.

If you do not agree to these Terms, you must not access or use the Service.

2. Definitions

• "Account" means your registered account on the Service.
• "Authorized User" means any individual granted access to your Account.
• "Content" means any data, text, information, or materials you submit to or through the Service.
• "Free Plan" means the no-cost tier of the Service subject to feature and usage limitations described on our pricing page.
• "Paid Plan" means any subscription tier for which you pay a recurring fee.
• "AI Platforms" means third-party large language model services, including but not limited to OpenAI's ChatGPT, Google Gemini, and Perplexity AI, whose outputs the Service monitors and analyzes.
• "AI Presence Data" means information about how a business or brand is represented in responses generated by AI Platforms.
• "Subscription Period" means the monthly or annual billing cycle selected at the time of purchase.

3. Description of the Service

beket.ai is an AI presence audit and optimization platform. The Service provides:

• Analysis of how your business is described, represented, or omitted by AI Platforms in response to user queries;
• Identification of inaccuracies, gaps, or misleading representations in AI-generated outputs about your business;
• Automated and assisted tools to help correct or improve your business's AI presence;
• Ongoing monitoring of AI Platform responses for changes or drift over time;
• Reporting and analytics dashboards summarizing your AI presence health.

The Service does not operate, control, or have any affiliation with the AI Platforms it monitors. Results reflect the outputs of independent third-party systems and may vary over time.

4. Eligibility and Account Registration

4.1 Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

4.2 Account Registration

To access the Service, you must register for an account by providing accurate, current, and complete information. You agree to:

• Maintain the security of your account credentials;
• Promptly notify us of any unauthorized access or breach at legal@beket.ai;
• Not share your account with others or permit third parties to access the Service using your credentials;
• Be responsible for all activity occurring under your account.

We reserve the right to suspend or terminate accounts that contain false information or that violate these Terms.

5. Free Plan and Paid Subscriptions

5.1 Free Plan

We offer a Free Plan that provides limited access to the Service at no charge. Free Plan features, usage limits, and availability are subject to change at our sole discretion. We reserve the right to modify, limit, or discontinue the Free Plan at any time with reasonable notice where practicable.

5.2 Paid Subscriptions

Paid Plans are available on a monthly or annual basis. By subscribing to a Paid Plan, you authorize us to charge your designated payment method for the applicable fees on a recurring basis at the start of each Subscription Period.

5.3 Pricing

Current pricing is displayed on our pricing page at https://beket.ai/pricing. We reserve the right to change pricing at any time. Price changes will take effect at the start of your next Subscription Period, and we will provide advance notice.

5.4 Taxes

All fees are exclusive of applicable taxes, levies, or duties. You are responsible for any applicable taxes associated with your use of the Service.

6. Billing, Payment, and Refunds

6.1 Payment Methods

We accept payment via the methods displayed at checkout. You agree to provide accurate and current payment information and to promptly update such information if it changes.

6.2 Automatic Renewal

Subscriptions renew automatically at the end of each Subscription Period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings, and cancellation will take effect at the end of the current Subscription Period.

6.3 No Refunds

ALL FEES ARE NON-REFUNDABLE. We do not provide refunds or credits for any partial Subscription Period, unused features, or early cancellation. This includes situations where you downgrade your plan, cease using the Service, or your account is terminated for violation of these Terms. You remain responsible for all charges accrued up to the date of termination or cancellation.

6.4 Failed Payments

If a payment fails, we may suspend your access to Paid Plan features until payment is resolved. We may retry failed payments and will notify you of any outstanding balance. Continued failure to pay may result in account termination.

7. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service to engage in any activity that violates applicable laws or regulations;
• Attempt to reverse engineer, scrape, or extract data from the Service beyond what is expressly permitted;
• Use the Service to collect or process information about third parties without their consent;
• Circumvent, disable, or interfere with security-related features of the Service;
• Upload or submit any content that is defamatory, fraudulent, or infringes the intellectual property rights of others;
• Use automated tools, bots, or scripts to access the Service in a manner that imposes unreasonable load on our systems;
• Resell, sublicense, or otherwise commercially exploit access to the Service without our written consent;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

Violation of this policy may result in immediate suspension or termination of your account.

8. Intellectual Property

8.1 Our IP

The Service, including all software, algorithms, interfaces, designs, trademarks, and content created by beket.ai, is owned by or licensed to us and is protected by Canadian and international intellectual property laws. These Terms do not grant you any ownership rights in the Service.

8.2 Your Content

You retain ownership of any Content you submit to the Service. By submitting Content, you grant us a limited, non-exclusive, royalty-free license to use, process, and store your Content solely to provide and improve the Service for you.

8.3 Feedback

If you provide us with feedback, suggestions, or ideas regarding the Service, you grant us an irrevocable, perpetual, royalty-free license to use such feedback for any purpose without obligation to you.

9. Data, Privacy, and AI Usage

9.1 Privacy Policy

Your use of the Service is also governed by our Privacy Policy, available at https://beket.ai/privacy, which is incorporated into these Terms by reference.

9.2 Data Processing

We process your Content and account data to deliver the Service, generate reports, and provide support. We implement reasonable technical and organizational measures to protect your data against unauthorized access, loss, or disclosure.

9.3 AI Training

We do not use your Content or data to train, fine-tune, or develop our own AI models or those of any third party. Your business data is used exclusively to provide the Service to you.

9.4 Third-Party AI Platforms

The Service interacts with third-party AI Platforms (such as ChatGPT, Google Gemini, and Perplexity AI) to retrieve and analyze AI-generated outputs. We do not control these AI Platforms and are not responsible for their outputs, policies, or availability. Your use of the Service in relation to these platforms is subject to the terms and policies of each respective third-party provider.

9.5 Accuracy of AI Presence Data

AI Presence Data generated by the Service reflects snapshots of third-party AI Platform outputs at specific points in time. AI responses are inherently variable and may change without notice. We do not guarantee that the AI Presence Data will be complete, current, or accurate. Results should be treated as informational and not as professional, legal, or reputational advice.

9.6 International Users and Privacy Rights

The Service is available to users globally. Depending on your location, you may have rights under applicable privacy legislation, including but not limited to:

• European Economic Area and United Kingdom: the General Data Protection Regulation (GDPR) and UK GDPR, including rights of access, rectification, erasure, restriction, portability, and objection;
• California, USA: the California Consumer Privacy Act (CCPA/CPRA), including the right to know, delete, correct, and opt out of sale or sharing of personal information;
• Canada: the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation, including British Columbia's PIPA;
• Other jurisdictions: additional rights as required by applicable local law.
